The H-1B visa gives foreign professionals an opportunity to work in the United States. It permits employers to hire qualified foreign workers in specialty occupations on a temporary basis. To be eligible for the H-1B visa, the U.S. employer and potential employee must adhere to the conditions and regulations of the U.S. Citizenship and Immigration Services (USCIS).

At the Law Office of Matthew Archambeault, we are committed to helping foreign workers obtain the outcome they desire. With more than 10 years of experience, our Philadelphia immigration lawyer has a comprehensive understanding of the U.S. immigration system to help you navigate through the complexities of the application process.

H-1B Requirements

In order to qualify for an H-1B visa, the job offered must be considered as a “specialty occupation.” You must have a bachelor’s degree or an advanced level of education certification from an accredited university or college. Work experience is not a necessary; however, education requirements may be substituted with work experience (one year at a university = three years of work experience).

Examples of qualified positions include the following:

  • Professors
  • Engineers
  • Accountants
  • Researchers
  • Medical providers
  • Architects
  • Scientists

The H-1B visa is limited to an annual cap of 65,000 visas every fiscal year. However, there are exemptions available from the cap, especially for beneficiaries with a U.S. master’s degree or higher (if it is filed among the first 20,000 petitions available) or if the H-1B worker is employed or petitioned on behalf of an institute of higher education, nonprofit entities, and government research organizations.

H-1B visa holders may stay in the U.S. for up to three years. Your time period may be extended, but it cannot go beyond six years total.
