EB-1 Requirements

The following are three types of EB-1 visas:

  • EB-1A – For individuals with “extraordinary abilities” in the sciences, arts, athletics or business
  • EB-1B – For extraordinary professors and researchers
  • EB-1C – For extraordinary executives and managers

For EB-1A applicants, you must meet three of the following 10 types of criteria to prove extraordinary ability in your field:

  • Receipt of lesser nationally or internationally recognized prizes or awards for excellence
  • Published material about you in a professional or major trade publications or other major media
  • Authorship of scholarly articles in professional or major trade publications or other major media
  • Membership in associations in the field which demand outstanding achievement of their members
  • Original scientific, scholarly, artistic, athletic, or business-related contributions of major significance to the field
  • Either individually or on a panel, you’ve been asked to judge the work of others
  • Your performance of a leading or critical role in acclaimed organizations
  • Commercial achievements in the performing arts
  • Your work has been displayed at artistic exhibitions or showcases
  • Evidence that you require a high salary or other substantially high remuneration in relation to others in the field

For EB-1B applicants, you must meet two of the following six types of criteria to prove extraordinary ability in your field:

  • Receipt of lesser nationally or internationally recognized prizes or awards for excellence
  • Published material about you in a professional or major trade publications or other major media
  • Authorship of scholarly articles in professional or major trade publications or other major media
  • Membership in associations in the field which demand outstanding achievement of their members
  • Either individually or on a panel, you’ve been asked to judge the work of others
  • Original scientific or scholarly research contributions in the field

For EB-1C applicants, you must:

  • Have been employed outside the United States in the three years prior to submitting the petition for at least one year by a firm or corporation in order to pursue entry in the United Sates to continue their service
  • Have been employed outside of the United States in an executive or managerial capacity and with the same employer, an affiliate, or a subsidiary of the employer

For EB-1A applicants, you may petition for yourself by filing a USCIS Form I-140, Petition for Alien Worker. For EB-1B and EB-1C applicants, your employer must file USCIS Form I-140, Petition for Alien Worker. For any EB-1 visa, you do not need to a PERM Labor Certification.
